These Terms of Service ("Terms," "Agreement") govern your access to and use of the BuffBook website, applications, and custom programming services (collectively, the "Service") operated by BuffBook ("us," "we," or "our").
Please read these Terms carefully before utilizing the Service. Your access to and use of the Service is conditioned entirely upon your unequivocal acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Explicit Medical and Liability Disclaimer
THE SERVICE, INCLUDING BUT NOT LIMITED TO ALL WRITTEN CONTENT, TRAINING FRAMEWORKS, EXERCISE CUES, AND CUSTOMIZED MESOCYCLE PROGRAMMING, IS PROVIDED EXCLUSIVELY FOR INFORMATIONAL AND EDUCATIONAL PURPOSES. NO CONTENT PROVIDED CONSTITUTES MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT, NOR SHOULD IT BE CONSTRUED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL CONSULTATION.
YOU EXPRESSLY AGREE THAT YOUR ENGAGEMENT IN ANY PHYSICAL ACTIVITY, WEIGHTLIFTING, OR EXERCISE REGIMEN DETAILED WITHIN THE SERVICE CARRIES INHERENT RISKS OF SEVERE BODILY INJURY, PHYSICAL HARM, OR DEATH. BY UTILIZING THE SERVICE, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS. BUFFBOOK, ITS CREATORS, AFFILIATES, AND AGENTS SHALL BE HELD COMPLETELY HARMLESS AND ASSUME NO LIABILITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INJURIES, OR LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR RELIANCE ON OR EXECUTION OF ANY INFORMATION OR PROGRAMMING PROVIDED BY THE SERVICE.
2. Purchases and Financial Terms
If you wish to purchase any product or service made available through the Service ("Purchase"), including custom mesocycle programming, you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address.
No Refunds: Due to the bespoke, labor-intensive, and digital nature of the custom programming services provided, ALL SALES ARE STRICTLY FINAL. Once an assessment has been submitted and the formulation of the custom mesocycle has commenced, no refunds, chargebacks, or prorated credits will be issued under any circumstances, notwithstanding any failure to utilize the provided programming.
3. Intellectual Property Rights
The Service and its original content (excluding User-provided data), features, methodologies, mathematical frameworks, and functionality are and will remain the exclusive property of BuffBook and its licensors. The Service is protected by copyright, trademark, and other applicable intellectual property laws. Our intellectual property may not be utilized, reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without our express, prior written consent.
4. User Accounts and Security
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a material breach of these Terms, which may result in immediate termination of your account on our Service.
You are solely responsible for safeguarding the cryptographic keys or passwords that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
5. Limitation of Liability
IN NO EVENT SHALL BUFFBOOK, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
6. "AS IS" and "AS AVAILABLE" Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request data deletion.
9. Amendments to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, you must immediately cease utilizing the website and the Service.
